Home Depot Employee Fired For Chasing Shoplifter Sues For $1.5 Million [Don't Stop,Thief]

A Home Depot employee who was fired after he chased a man who had been vandalizing a vending machine is now suing Home Depot.


The lawsuit stated:

• Miller worked for Home Depot from March 13, 1995 to his termination Aug. 27, 2007. When terminated, he worked as manager for the Home Depot in Murfreesboro.

• When Miller arrived at work Aug. 20, 2007, the head cashier called to report a man struck a soft drink machine with a crowbar outside the building. From her tone of voice, Miller believed the cashier feared for her safety.

• Miller and assistant manager Robert Weiss saw two other employees detaining the suspect who was about 6 feet tall and weighed 180 pounds. When an employee asked for the cash taken from the machine, the suspect tossed the crowbar in a trash can and hurried away with the money. Two employees and Miller chased the suspect until they grabbed him.

• The manager counseled with the suspect, telling him he could stop using drugs and change his life.

He was not a customer of the store.

Murfreesboro Police took the suspect into custody. Police asked Miller for an affidavit for the arrest warrant. Miller obtained permission from the legal department to proceed with the prosecution.

• Later, Miller learned he was the subject of a company investigation. He was terminated Aug. 27.

Miller's lawsuit stated he acted in concern for his employees, perceiving the suspect to be a threat to employees and customers. Under state law, Miller was justified to use reasonable force to protect employees and property.

His termination to protect others and arrest the suspect "jeopardizes clearly established public policies," the lawsuit stated.

Gilley said Miller responded because the cashier feared the suspect with a crowbar.

"Rusty Miller instinctively has as we hope everyone would act when a human life is potentially in danger," Gilley said. "In response, he was terminated."

Miller offered to help the thief get help for a drug problem, his attorney said.

"How much more compassionate can you get?" Gilley said.

Attached to the lawsuit was the form Home Depot used to terminate Miller.

"Rusty pursued and detained a customer in the parking lot after the customer had broken into the vending machine outside the store," the document stated. "Rusty's actions are a violation of our company code of conduct -- violation of asset protection policy."

Kind of wonder why they stop you to look at your receipts if detaining you will get them fired. Poor Rusty.

Concidering Committment

Pay attentin to your commitments.

While most of us fear committing, it's good to weigh the cost of any committment we are concidering. We need to feel consistently positive that it's an appropriate commitment for us.

many of us have a history of jumping - leaping headfirst - into committments without weighing the cost and the possible consequences of that particular commitment. When we get in, we find that we do not really want to commit, and feel trapped.

Some of us may become afraid of losing out on a aprticular opportunity if we don't commit. It is true that we will lose out on certain opportunities if we are unwilling to commit. We still need to weigh the commitment. We still need to become clear about whether that commitment seems right for us. If it isn't, we need to be direct and honest with others and ourselves.

Be patient. Do some soul searching. Wait for a clear answer. We need to make our commitments no tin urgency or panic but in quiet confidence that waht qwe are committing to is right for us.

If something within says no, find the courage to trust that voice.

This is not our last chance. It is not the only opportunityu we'll ever have. Don't panic. We don't have to commit to what isn't right for us, even if we try to tell ourselves it should be right for us and we should commit.


Often, we can trust our intuitive sense more than we can trust our intellect about commitments.

in the excitrement of amking a committment and beginning, we may overlook the realities of the middle. That is what we need to concider.

We don't have to commit out of urgency, impulsivity, or fear. We are entitled to ask, Will this be good for me? We are enittled to ask if this committment feels right.

Today, God, guide me in making my committments. Help me say yes to what is in my highest good, and no to what isn't. I will give serious concideration before I commit myself to any activity or person. I will take the time to consider if thew commitment is really what I want.

THEN I will be happy

I've been having some insights lately and this one was so big, I decided to share it.

Before I met my husband, I thought, if only I could find "the one" THEN I would be happy. When I met him and decided he was "the one" I thought, once we get married THEN I will be happy. Once we were married I thought, when we have children, THEN I will be happy. After we had children I thought, once we buy our own house, THEN I will be happy. After we bought our own house and the alcohol began to cause problems I thought, when he gets sober THEN I will be happy. When he got sober and we tried to work on our marriage I thought, we will work out our problems and get back together and THEN I will be happy.

I've spent my entire life making my happiness dependent on other people and external events. It saddens me to think of all the joy I must have missed along the way because I was so focused on the future and the next thing that would make me happy.

I've finally learned that I could've been happy all along. All those things I thought would make me happy didn't and happiness has been inside me the whole time. I just refused to accept it. I'm so grateful to have finally found it. I just wasn't looking in the right place. :)

I hope this means something to someone out there. I was going to write it in my journal, but it felt like something that needed to be shared..............

Very Worried...

Hi Everyone,

So many knew friends here, I have not been on so much lately so my post to many of the our knew friends might not be so clear to what I am talking about and to start over would be a novel.

Basically my husband (was husband) is addicted to crack, has been for 5 + years now. My boys were 12 and 14 at the time. Many here know of the problems I have had with the boys over the years since this has happened. Drug using pot, yelling, screaming at me, police involved. The boys are now 17 and 19. My oldest got a job in a mill, they were on shut down this week and I have been on holidays this week. I have been home all week painting, my son has spent his whole week in his room, from the bottom of my heart I know there is know drug use or alcohol happening. He did move out and went to live with his girlfriend and her family, he has been home now for 6 weeks and they really don't seem to see to much of each other....she never comes here and if he does go see her it is only for an hour or so.

I was going out with a friend the other day just to go to the dump and grab a coffee asked him if he wanted to go for the ride...no he said I am gong to get a shower. About 2 weeks ago I had him in the ER with a major headache, he has a headache everyday. He has been to the Dr. and I think the Dr. might of thought depression and put him on a med, he would not take it. Then back to the Dr he went again for the headache, so Dr sent him to a specialist and he had a head scan done, but nothing showed up. The specialist put him on a medication...I searched it and it was for depression, epilepsy and migraine headaches.

I did a bad thing, I went into his room when he was not home and check to see if he was taking he medication...not. I didn't ask him anything...but I know he has said before that he hates taking pills.

But I am very worried about him,
